
“ The Driver's Privacy Protection Act (DPPA)
is a federal law that regulates how information from DMV
records can be released and shared. The DPPA regulates how
motor vehicle departments release driver records and vehicle
records. The DPPA also regulates how a recipient of DMV records
can share information with another person.”
“ The purpose of the DPPA is to restrict
access to personal information on DMV driver records
and vehicle records. The DPPA regulates how and when
the DMV can release personal information that is on
DMV records. The law allows the DMV to release personal
information only for purposes defined in the DPPA.”1
ChoicePoint’s IDV product uses DPPA-governed information to deliver quality
information for decisions that matter. Pursuant to the DPPA, ChoicePoint IDV
users may only access the data for Drivers License verification within this solution
for the following permitted use:
For use in the normal course of business by a legitimate business or its
agents, employees, or contractors, but only-
(A) to verify the accuracy of personal information submitted by the individual
to the business or its agents employees, or contractors; and
(B) if such information as so submitted is not correct or is no longer
correct, to obtain the correct information, but only for the purposes of
preventing fraud by, pursuing legal remedies against or recovering on a debt
or security interest against, the individual.
ChoicePoint IDV users are required to certify their intended use of the IDV
product before they will be allowed access. Any violation of such certification
is a violation of the Subscriber Agreement entered into by such user with ChoicePoint,
as well as of federal and state law.
